NEC Lawyer Accuses UP of “Holding Liberia Hostage”

– Says party’s claims are frivolous and has nothing to prove against the NEC

The lead lawyer of the National Elections Commission (NEC), Frank Musa Dean, has accused the ruling Unity Party (UP) of having sinister motives as they proceed with the ongoing alleged electoral irregularities and fraud case.

UP, which is the intervening party in the Liberty Party case, has taken center stage and demanding more pieces of evidence whenever the hearing resumes. The Supreme Court recently mandated the NEC to expeditiously adjudicate all cases arising from the October polls, and that in case any party is not satisfied with the ruling from the NEC hearing officer or the Board of Commissioners (BOC) an appeal may be taken to it (Supreme Court).

Cllr. Dean said UP, who has submitted the names of 16 persons to testify on their behalf, is still requesting for additional names, which he thinks could cause unnecessary delays.

“Liberty Party rested with their arguments after producing witnesses in two days, but UP, the intervener who bypassed the election law to complain or intervene, is now holding the country hostage. They have evil motives and their objectives, if granted, will throw this country into chaos,” he claimed.

He noted that UP’s action is “mischievous, unfair and ridiculous, more so by their continuous subpoena of addenda and other reports not in dispute at the hearings.”

Dean’s reaction followed Cllr. Varney Sherman’s argument that the ongoing hearings are only a formality as provided for by law because they will pray the Supreme Court to investigate all matters before the NEC’s hearing office.

Dean said UP, LP and others accusing the NEC of wrongdoing do not constitute the overall population of the country.

“They alone do not constitute the population of our country for which they have to keep us tied down. We need to move forward and I believe that the way forward is for you, Mr. Hearing Officer, to take control of this process. They should not continue to make a request for evidence they cannot produce against the Commission, but yet demand each day for them. If they wish to, let them go to the Supreme Court,” he said.

Cllr. Sherman and team have vowed that they will not rest until the NEC produces all records showing the sought after pieces of evidence.

The NEC’s subpoenaed witness, Lamin Lighe, testified yesterday that the NEC has committed no fraud as claimed by the ruling Unity Party and others contesting the October 10 polls.

Taking the witness stand to validate or invalidate the accusations of irregularities and fraud levied against the Commission, Lighe said the NEC procured extra sample ballot papers for civic voter education purposes and another for official purpose of voting for representative and presidential candidates contesting the elections.

As executive director of the electoral body, he noted that the serial numbers assigned to the official ballot papers were placed at the upper left corner of each, which was not to the knowledge of the voting population.

“For the sanctity of our electoral system and considering security implications, we instructed our staff at all polling centers to note down numbers of people voting, ballots given out to voters and all relevant details so as to trace the accuracy of our reports,” he said.

About the alleged discovered ballots in Kwenabu, Grand Gedeh Electoral District #2, he pointed out that they are fake ballots and are in no way synonymous to the official ballots used on October 10 across the country.

“The back sides of the official ballots for presidential candidates have red stripes while the ballots for the representatives have green stripes and all ballots used and unused during the elections can be accounted for by this Commission,” he said.

Dennis Saah Buopoe, another UP witness, said his name was not found on the Final Register Roll (FRR) when he went to Rock International School in Margibi Electoral District #1. He said he observed that there was no preference given to voters with special needs.

“After standing in the queue for over three hours and succeeded going in, my name was not found on the FRR,” Buopoe said, noting however that his name was added in the addendum.

Other witnesses, including Sen. Geraldine Doe-Sheriff and former NEC chairman James Fromoyan are yet to testify on behalf of the complainant and core complainants.

The hearing officer, Cllr. Muana S. Ville, has meanwhile ordered that should UP fail to produce its remaining witnesses and pieces of evidence it claims to have, said witnesses will be dispensed with and no other arguments or subpoena will be entertained.

“After tomorrow (Nov. 15) the hearing office will be weighing the merits and demerits and rule according to its investigations. No further delays, and whoever thinks they have evidence let them come with it and allow us to save time,” he concluded as he reluctantly granted Sherman’s request to proceed with the hearing today.

  2. IT IS APPARENT THAT THE SUPREME COURT HAS TO TAKE CONTROL OF THIS ELECTORAL PROCESS OR IT MAY LEAD TO VIOLENCE! IT IS ALSO APPARENT THAT THE NEC DOES NOT HAVE FULL CONTROL OF THE CASE. UP SHOULD DICTATE TERMS OF THE ADJUDICATION OF THE CASE IF THE NEC HAS CONTROL OF IT. THE PRESENTATION OF NECESSARY EVIDENCE IS A MATTER OR PREROGATIVE OF THE COURT, AND NOT THE COMPLAINANTS. THE NEC NEEDS TO TAKE CONTROL OF THE CASE AND RAP IT UP ASAP!

  3. Whether one aggrees or not with Couselor Dean, his accusation against UP of holding “Liberia hostage” with frivolous delaying tactics takes some guts, and a dramatic irony for three salient reasons:

    First, it is being made by the same NEC legal team which rightfully argued, before then Supreme Court justice in – chamber Philip Banks, that the 2014 claims of electoral “irregularities” in the Cape Mount Senatorial race, which Counselor Sherman won, were “frivolous” and intended to unnecessarily delay his confirmation.

    Second, UP happens to be the ruling party, the government in power for the past dozen years, entrusted with the sacred tasks of providing public safety and national security for citizens and country respectively, hence the charge of holding the country “hostage” is a grave one, to say the least.

    Third, Counselor Dean’s indictment of wilful delay of the proceedings against the ruling party UP could be perceived as credible by anxious citizens, considering the confession of Dr. Allan White (a foreigner) that he has been encouraging the complaining parties to not compromise until the term of EJS expires so that an “interim government” would be put in place.

    (Strangely, for partisan reasons many Liberians don’t flinch from the admitted destabilizing actions of an alien with known spy ties, something that would have resulted in FBI investigations had it occurred in the US)

    Well, political polarizations and assassinations have been features of the American democratic climate since post – civil war lust for vengeance led to the heinous cowardly murder of a defenseless President Abraham Lincoln, who was relaxing and watching some amusing play being performed at a theater. But no one – even in the present US political hornest’s nest where “impeach Trump” is the prevailing wishful thinking of Liberals and the Left – is suggesting an “Interim government”.

    We, Liberians, must not forget the recent history of our country; let’s quickly remove and disarm this concealed ticking time bomb by the following means:

    A), for the sake of continuing the run – off, if need be, recuse Chairman Korkoya of NEC. B), under the same token, let some of the proven “irregularities”, like providing a voters’ roll before the elections, and so on be corrected. C), the precondition for both though is that the run – off and inauguration of a new president take place during the presidency of EJS to ensure a smooth democratic transfer of power.

    The aforementioned proposals aren’t the best, some would have more practical ideas; however, they are geared towards preventing the country from sliding into a slippery slope. But, mind you, urgency is a must. The vast majority Country and Congua marginalized can’t wait forever while the well – off indulge in endless pussy – footing. Remember, in asmuch as the Supreme Court is the final arbiter in elections’ results disputes, it doesn’t mean that when “delay” is likely to pose a threat to the security of the state, some form of arbitration; a compromise, if you will, among the feuding parties can’ t take place outside its jurisdiction. After all, when push comes to shub, our highest court has only power of “judgment”, not power of “enforcement”.

The guy who unearthed the secret communications between Weah and the murderous Charles Taylor from his prison in the UK.We know many of Taylor fans are upset because Dr. West almost singlehandedly got Mr. Taylor to pay for his crimes committed against the peace loving people of Sierra Leone. Instead of Liberians trying to discredit Dr. West, we should be recommending him for the Nobel Peace Prize.

Counselor Dean and the entire N.E.C are holding Liberia hostage due to their failure to conduct a free and credible election. The October 10, election was marked with fraud and dishonesty. N.E.C employees were not adequately trained and prepared for the task ahead. We know what is going on Counselor Dean. All of you at N.E.C must resign because you have failed the Liberian people.

  6. From known facts, Dr. Allan White’s motives are neither altruistic, nor of journalistic value; instead, he has financial interest in the outcome being actively advanced. Thus, unquestionably, this lobbyist is unjustified in pushing for an interim government in Liberia. Not to mention that had a foreigner done so during the Bush versus Gore 2000 presidential elections’ imbroglio, he or she would’ve not only faced scrutiny, but also placed on active FBI’s profiling and surveillance list.

    Our comment has nothing to do with Charles Taylor, and those who think that Sylvester Moses, of all people, is a “fan” of anyone needs a psychiatrist. The state comes first by training and practice, and right now it is jumping head first into a national crisis, therefore, some of us who witnessed how easy and fast that took place twice, with horrendous consequences, are rational enough to be wary and even scary.

    Of course, we weren’t amazed that nothing was added to or subtracted from the three – a, b, and c – proposals to help find a solution to the growing constitutional problem confronting our nation. What a shame that nowadays it is considered brilliant to be flippant about existential matters, especially, from a safe distance outside the potential threat zone.

We received with gratitude and a sigh of relief the statement from the US Embassy in Monrovia urging all sides – political parties, NEC, and Supreme Court – to “expeditiously” correct problems for the top two finishers to slug it out in a run – off in order for a peaceful democratic transfer of power in January this year. It is sad that for partisan or selfish reasons some of us would that millions suffer while we bargain for endless self – aggrandizement. Thankfully, this happens to be the time the international community, especially US, has given notice that it can’t carry Liberia on its back from cradle to grave: Cut the crap and grow up, citizens!
